General Terms and Conditions (GTC)

for the use of the mobile app Travee

1. Provider and Scope

(1) The provider of the app is Travee GmbH, Kolonnenstraße 8, 10827 Berlin, contact@travee.eu, HRB 277783 (hereinafter referred to as the “Provider”).
(2) These GTC govern the conclusion, content, and performance of the user agreement for the Travee app (hereinafter “Travee”) between the Provider and the users (hereinafter “User”).
(3) Deviating terms and conditions of the users do not apply unless the Provider expressly agrees to their validity.

2. Subject Matter and Scope of Services

(1) Travee is an AI-based personal travel companion that assists users before and during their trips. The main functions include, among others:
a) Travel information about the destination (e.g. best travel time, mobility, food, events),
b) an integrated AI-powered guide (“Guide”) that answers travel-related questions in a dialogue format,
c) an interactive audio guide that leads the user through the city and provides interesting information.

(2) Travee itself does not conclude any travel, transport, accommodation, or other travel service contracts with users. If interested in activities/experiences, users are redirected to external providers, in particular GetYourGuide.

(3) The Provider may reasonably modify, supplement, or discontinue content/functions (e.g. due to security, legal, or market changes). Material changes will be announced in the app or via notification.

3. Accounts, Age, and Usage Scope

(1) Registration is required to use the app.
(2) Minimum age: The app may be used by individuals aged 16 and older. Under 16 only with parental consent.
(3) Access is personal; login data must be kept confidential. Disclosure to third parties is not permitted.

4. Notes on the AI-Based Guide (No Advice)

(1) The Guide generates content automatically based on data sources and probabilistic language models. Answers may be incomplete, inaccurate, or outdated.
(2) No professional advice: The content does not constitute legal, safety-related, financial, or any other professional advice in the travel context. Decisions should not be based solely on the Guide’s output; users are responsible for verifying information independently.
(3) Limitation of liability for Guide content: To the extent permitted by law, the Provider assumes no liability for losses or damages resulting from reliance on the Guide’s content or recommendations (see § 12).

5. Fair Use and Technical Usage Limits

(1) The Guide is subject to a Fair Use Policy. Unlimited use is technically restricted.
(2) The Provider may impose usage limits, such as the number of requests per time frame, concurrent sessions, session duration, data traffic, token/character limits, as well as measures like rate limiting, queuing, throttling, or temporary suspensions.
(3) The current limits are displayed in the app/help section or contextually as needed.
(4) Abuse protection: In case of signs of automated, excessive, or improper use (e.g. scraping, bot traffic, circumvention of limits), the Provider may block requests, restrict functions, or temporarily/permanently suspend accounts.

6. Acceptable Use

The following are prohibited in particular:
a) illegal activities,
b) uploading/transmitting harmful code (malware, scripts),
c) circumventing security/access restrictions,
d) reverse engineering, decompiling, or modifying the app unless legally permitted,
e) using the app to create misleading or harmful content (e.g. undisclosed deepfakes, fraudulent travel offers),
f) infringement of third-party rights (copyright, trademark, personal rights).

7. Third-Party Information, Maps, and Links

(1) Travel information may be based on third-party data (e.g. maps, public transport, weather, or safety sources). The Provider assumes no responsibility for their accuracy, completeness, or availability.
(2) External links are third-party content; responsibility lies solely with the respective operator.

8. Availability, Early Access / Beta

(1) Travee strives for high availability; however, uninterrupted use at all times cannot be guaranteed.
(2) If the app is marked as Early Access / Beta, it represents a pre-release version. Errors, data loss, incompatibilities, or functional changes may occur. Feedback from Early Access users may be used for further development.

9. Pricing, Billing, and Withdrawal (if applicable)

(1) The app includes free and paid features (e.g. subscriptions or usage packages for the Guide). Prices and service details are shown in the app (including taxes, where applicable).
(2) Billing is handled via RevenueCat. Cancellation/management of subscriptions is done through the Play Store.
(3) Withdrawal: Consumers may have a statutory right of withdrawal for digital content/services; further details and conditions are provided separately in the app.
(4) In case of payment default or misuse, the Provider may suspend services.

10. Updates, Changes, and Maintenance

(1) The Provider may provide updates (security/function updates) and is entitled to require their installation.
(2) Planned maintenance will be announced – if possible – in advance; temporary restrictions may occur.

11. Rights to the App, Usage Rights, and User Content

(1) The app and its content (texts, graphics, software) are legally protected.
(2) The Provider grants users a simple, non-transferable, revocable right to use the app for private purposes only.
(3) If users contribute content (e.g. reviews, feedback), they grant the Provider a simple, geographically unrestricted right of use for the purpose of app operation and further development. Users warrant that they are entitled to grant such rights.

12. Liability

(1) The Provider’s liability is governed by statutory provisions.
(2) The Provider is fully liable for intent and gross negligence. For slight negligence, liability applies only in the event of a breach of essential contractual obligations (cardinal obligations); in such cases, liability is limited to the foreseeable, typical contractual damage.
(3) Guide content: To the extent permitted by law, the Provider is not liable for damages resulting from users relying on content/recommendations of the Guide or making decisions based on such content (see section 4).
(4) For third-party services (section 7), the respective third-party provider is solely responsible.

13. Data Protection

(1) Personal data is processed in accordance with the GDPR and applicable laws.
(2) Details are provided in the Privacy Policy, which forms part of this agreement.

14. Term, Termination, Suspension

(1) The agreement is concluded for an indefinite period and may be terminated by either party at any time, unless a current, ongoing paid model prevents it.
(2) In the event of violations of these GTC (in particular sections 5–6), the Provider may temporarily suspend or permanently terminate accounts.

15. App Store Terms (Google Play)

In addition to these GTC, the terms of use of Google Play apply. In the event of a conflict, mandatory store rules take precedence over conflicting provisions of these GTC.

16. Final Provisions

(1) Applicable law: The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection laws of the user’s country of residence remain unaffected.
(2) Jurisdiction: Where legally permissible, the place of jurisdiction is the Provider’s registered office.
(3) Contract language is German.
(4) Online Dispute Resolution: The EU Commission provides an Online Dispute Resolution (ODR) platform. The Provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board, unless legally required.
(5) Severability clause: Should any provision be or become invalid, the validity of the remaining provisions remains unaffected. The statutory provision shall apply instead of the invalid one.
(6) Changes to the GTC: The Provider may amend these GTC for the future where there is a valid reason (e.g. change in law, functions). Users will be informed in due time of material changes; if a user does not object within a reasonable period or continues using the app, the changes are deemed accepted. This will be explicitly pointed out.
